Protect on an international level.

Without borders.

File an international patent application with foresight and a strategic approach

Success on the international stage requires more than just a great innovation—you need a protection strategy that extends beyond national borders. Usually, what's needed isn’t a “world patent”, but a comprehensive, strategic application in key countries, clear and precise patent claims as well as effective enforcement and monitoring. At FLACH BAUER & PARTNER, we help you achieve exactly that.

Scope of protection.

What is an international patent?

There’s no such thing as an international patent. The term usually refers to an application as part of the PCT procedure (Patent Cooperation Treaty). This means that with a single application, you can prepare for protection in up to 157 countries, and gain valuable time to choose the right target countries. European or national procedures can be used as an alternative or in addition. We advise you on the approach that best fits your technology, financial considerations, and target markets.

Our tip: A smart, international strategy begins with the first national application. Planning ahead makes it easier to prioritize—especially for mid-tier companies and corporations focused on growth markets.

When is an international application worthwhile?

Not every invention needs worldwide protection. But companies facing potential imitations from Asia or competition in the US should act early, either through individual national applications or a PCT application. PCT applications are ideal for inventors and companies seeking international patent protection in several countries and wanting additional time to decide on the countries where they wish to pursue patent protection.

How does a PCT application work?

The PCT procedure starts with an international application to the German Patent Office (DPMA) or the European Patent Office. You then have up to 30 months to apply for protection in specific countries or regions. This gives you time to observe the market, bring in investors, and refine your product. We will provide technically robust, commercially sensible, and strategically smart support for your PCT application.

We help you evaluate:

A patent is a financial tool, not an end in itself. We work closely with you to develop the right strategy.

  • Where are the real market opportunities?
  • Where might you face competition?
  • Where does it make commercial sense to file an application?
  • Which countries are relevant in terms of your supply chain or licensing?

What unique aspects apply to corporations and large mid-tier companies?

Beyond a certain company size, both the need for protection and the complexity of the IP landscape increase. The interests of various stakeholders—from R&D to business development—have to be considered. International patent protection must therefore not only be technically robust, but also aligned with the overall strategic direction.

We support internal IP departments or assume coordinating responsibilities as an external partner. We bring technical expertise, experience of international procedures, and a keen understanding of business objectives to the table.
